The rising US crypto enforcement tsunami in 2022

US federal and state regulators and enforcement agencies took aggressive action against US and Non-US crypto platforms in 2021. From the $100m penalty against a non-US crypto exchange for US sanctions violations, to enforcement actions by various federal and state securities, commodity derivatives, and money transmission regulators against DeFi, crypto-lending, and other trading platforms and market participants, a wide range of US regulatory and enforcement agencies are aggressively enforcing US laws. The Biden Administration and US enforcement agencies have also made clear that regulation and enforcement of crypto activities are a top priority going into 2022. This session will include a breakdown of key regulatory issues and enforcement trends that we expect in 2022.

Digital cash – CBDCs at the supermarket checkout

Our expert panel will discuss the potential cases for a CBDC to be used for retail payments (rCBDC). An rCBDC would have to coexist with existing retail payments systems, including cash and payment cards, so the questions that arise are - how could a CBDC fit into the current UK payments landscape, how might it interact with other forms of money, and what are the different ways this might be achieved, considering the trade-offs and risks associated with the different approaches?

We will discuss the relative merits of a ‘create and destroy’ payment-only option, in which value would not be stored in CBDC and only pass through it, alongside a ‘store of value’ option, or “custody model”, where CBDC would be held until required, converting into other forms of money only where it was necessary to use a payment system other than the CBDC system.

Finally, we will discuss how this will appear to end-users (both retail customers and merchants) and how such a proposed rCBDC might fit with their requirements.
